Terms of Service

The rules for working with Tap & Hook, in plain language.

Version 1.1 · Effective October 26, 2026

These Terms of Service (“Terms”) govern your use of tapandhook.com and the video ad services provided by Tap & Hook (“Tap & Hook,” “we,” “us,” or “our”) to you, the business or person ordering them (“you” or “Client”).

1. Acceptance of these Terms

By using our services, submitting our order or project form, approving a quote, or paying for an order, you agree to these Terms and to our Privacy Policy. If you are accepting on behalf of a company, you confirm you have authority to bind it. If you do not agree, do not use our services.

2. Our services

We create short-form video ads (“Ads”) and related ad copy for your products, as described in the package or plan you choose (each, an “Order”). Package contents, prices, revision rounds, and delivery times are those shown on our pricing page or in your written quote at the time you order.

3. How the Ads are made (AI disclosure)

  • Deliverables are created using AI-generated video, imagery, and voice, combined with the product photos and materials you provide, and then edited and captioned by us.
  • AI-generated content can contain imperfections. You review and approve every cut before final delivery.
  • Advertising platforms, including Meta and TikTok, have their own rules for labeling or disclosing AI-generated or digitally altered content. You are responsible for complying with those platform rules, including applying any required AI-content labels when you publish the Ads.

4. Orders, scripts, and approvals

  • After payment and receipt of your materials, we send script concepts with hook options. Production starts only after you approve a script.
  • Delivery times start once we have all required materials and your script approval. Delays in sending materials or feedback extend delivery times.
  • A new concept, product, or script after approval is a new Ad and is charged separately.

5. Prices and payment

  • All prices are final. Prices are in US dollars and do not include any taxes, which you are responsible for if they apply.
  • Payment is due in full before work begins, unless your written quote for a custom project sets a deposit schedule (for example 50% to start and 50% before final files are released). We do not start scripts or production until the required payment clears.
  • Payments are processed by a third-party payment processor. We do not see or store your full card details.
  • Monthly plans are billed in advance at the start of each billing period.

6. Satisfaction, revisions, and refunds

  • Your package includes a set number of revision rounds (1 on Starter, 2 on Standard and Growth, unless your quote says otherwise). Included revision rounds are the remedy if you are not satisfied with an Ad. Please request revisions within 7 days of each delivery.
  • A revision is a change to how an approved script is executed: swapping a shot, timing, caption wording, voice, music, or colors. If a generated shot cannot be made to look right, we replace it with a product-photo shot at no extra charge.
  • Refunds are given only if we fail to deliver the first cut of an Order. If we do not deliver a first cut within 7 days after the stated delivery time (not counting delays caused by waiting on you), you may request a full refund of that Order.
  • No refunds are given once a first cut has been delivered. For monthly plans, this applies to each month separately.
  • If we decline your project after you have paid (for example, because the product or the claims you need are not something we can make ads for), we refund the full amount you paid for that Order.

7. Your materials and warranties

You warrant that you own or have all necessary rights and permissions to the product images, videos, logos, trademarks, music, text, offers, and claims you provide (“Client Materials”), and that our use of them to make your Ads will not infringe anyone's rights or break any law. You grant us a limited license to use Client Materials only to provide the services.

8. Product claims and compliance

  • We do not create health, medical, or efficacy claims, or results claims, that we have not verified. Any such claim in your Ads must be your own wording, supplied and approved by you.
  • You are solely responsible for the truth and substantiation of every claim, price, and offer in your Ads, and for complying with advertising laws, including the FTC Act and FTC rules on endorsements, testimonials, and reviews. This is especially important for supplements and beauty products, where claims are closely regulated.
  • We do not make fake reviews or testimonials, or present generated people as real customers, and we may decline any request we believe is misleading or unlawful.

9. License and ownership

  • When you have paid in full for an Order, we grant you a perpetual, worldwide right to use, copy, edit, and publish the final delivered Ads and ad copy to advertise and market your brand, on any channel. To the extent we hold any ownership rights in the final delivered Ads, we assign them to you on full payment.
  • Some AI-generated material may not be eligible for copyright protection, so we cannot guarantee that you can stop others from using similar material.
  • Third-party elements such as licensed music, stock footage, or fonts remain subject to their own licenses, which we will tell you about at delivery.
  • We keep ownership of our working files, templates, methods, and unused concepts, except for raw clips and project files included in your package. We will only show your Ads in our portfolio with your written permission.

10. No guarantee of performance

We promise a process, not a result. Ad performance depends on many factors outside our control, including targeting, budget, offer, and platform decisions. We do not guarantee any sales, return on ad spend, clicks, views, or approval by any ad platform.

11. Monthly plans and termination

  • You may cancel a monthly plan at any time before your next billing date by emailing hello@tapandhook.com. Cancellation stops future billing. The current paid month continues through its end and is not refunded.
  • We may suspend or end services if you break these Terms, fail to pay, or ask us to make unlawful or misleading content. If we end services for our own convenience, we refund any amount paid for work we have not started.

12. Confidentiality

Each of us will keep the other's non-public business information (such as unreleased products, offers, sales data, and pricing) confidential and use it only for the services, except where disclosure is required by law. This does not cover information that is public or was already known to the receiving party.

13. Disclaimer

Except as stated in these Terms, the services and deliverables are provided “as is,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law.

14. Limitation of liability

To the fullest extent allowed by law, our total liability for any claim relating to the services is limited to the fees you paid us for the Order that gave rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, even if we were told they were possible.

15. Indemnification

You agree to defend, indemnify, and hold harmless Tap & Hook from any claims, losses, fines, and costs (including reasonable attorneys' fees) arising from your Client Materials, the claims and offers in your Ads, how and where you publish the Ads, your compliance with platform rules and advertising laws, or your breach of these Terms.

16. Independent contractor

We provide the services as an independent contractor. Nothing in these Terms creates a partnership, joint venture, or employment relationship.

17. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Michigan, and both parties consent to their jurisdiction.

18. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new version number and effective date. The version in effect when you place an Order applies to that Order. Continuing a monthly plan after a change takes effect means you accept the updated Terms.

19. Other terms

These Terms, together with your accepted quote or Order and our Privacy Policy, are the entire agreement between us about the services. If any part is found unenforceable, the rest stays in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent.
